The Oust app is published by SWADE SAS, 200 rue de la Croix Nivert, 75015 Paris, France (“we”). Contact: contact@swade.app. The publisher’s and the host’s details are in the legal notice.
1. Acceptance
By downloading or using Oust, you accept these terms. If you do not accept them, do not use the app. How we handle data is described in the Privacy Policy, also available from Settings → Legal.
If you downloaded Oust from the App Store, Apple’s standard license agreement also applies; Apple is not a party to these terms and is not responsible for the app or its support.
2. The service
Oust helps you sort the photos and videos on your device by swiping: right to keep, down to decide later, left to put in Oust’s trash. Sorting happens locally, on your device; your photos are not sent to any server.
Oust is free and ad-supported. A paid premium option is available (section 5).
3. Photo library access and ownership of your content
Oust needs your permission to access your photo library. Your photos and videos remain yours: we acquire no rights over them and do not upload them.
4. Deleting your photos: your responsibility
- Swiping left deletes nothing: the photo goes to Oust’s trash, from which you can take it back out.
- Deletion only happens when you confirm it from that trash and then, on iOS and Android 11 and later, in the system’s confirmation dialog. The items then go to the system trash (“Recently Deleted” on iOS), from which they can be recovered for the period set by the system (usually 30 days).
- On Android 10 and earlier, there is no system trash: after your explicit confirmation in Oust, deletion is immediate and permanent.
- If your library is synced (iCloud Photos, Google Photos…), the deletion may also apply to your other devices and to the cloud copy, depending on that service’s settings.
You alone decide what you delete. Check your selection before confirming and back up the photos you care about. We are not responsible for the loss of photos or videos you chose to delete, including after the system trash recovery period has expired.
5. Free version, ads and premium purchase
Free quota and rewarded ads. The free version lets you sort a limited number of photos: a first allowance, then a new free allowance every day. You can earn extra swipes by choosing to watch a rewarded ad; the number of swipes granted is shown in the app and may change. Earned swipes have no monetary value, cannot be exchanged or refunded, and are tied to the app’s installation on your device. The free version also shows an ad in the photo stack from time to time.
Oust Premium. Oust Premium is a one-time purchase, not a subscription, that unlocks unlimited sorting and removes all ads from the app, forever. The price is the one shown by the App Store or Google Play at the time of purchase, including taxes as applicable in your country.
- Payment is processed by Apple or Google, under their terms; we do not receive your payment details.
- The purchase is tied to your App Store or Google Play account. After reinstalling, or on another device using the same account and platform, use “Restore Purchase” in Settings.
- Promo codes: if you have a code, enter it in Settings → Promo Code; Oust then opens the store’s code redemption page, which validates it.
- “Forever” means for as long as Oust is offered and remains compatible with your device; it does not include porting to other platforms.
Refunds and right of withdrawal. Purchases are made from Apple or Google: refund requests must be sent to them, following their procedures. Your right of withdrawal and refunds are governed by the terms of the store that takes the payment. This does not affect your statutory rights, including the legal guarantee of conformity for digital content.
6. Permitted use
You agree not to decompile, disassemble or attempt to extract the app’s source code (except where the law allows it), not to circumvent the quota, the ads or the premium purchase, and not to use Oust for illegal purposes.
7. Intellectual property
The app, its name, logo, design and code are the exclusive property of SWADE. We grant you a personal, non-exclusive, non-transferable right to use Oust on your devices, in accordance with these terms and the rules of the store you downloaded it from.
8. Liability
Oust is provided “as is”. We do our best to make it work properly but cannot guarantee it will be free of bugs or interruptions. To the extent permitted by law, we are not liable for indirect damages, nor for data loss resulting from deletions you confirmed (section 4). Nothing in these terms limits our liability where the law forbids it, nor the rights the law gives you as a consumer.
9. Changes
We may change these terms, for example when the app evolves. The last-updated date is shown at the top of this page. A change does not apply retroactively to a purchase already made.
10. Governing law and disputes
These terms are governed by French law. If you are a consumer residing in the European Union, you keep the protection of the mandatory provisions of the law of your country of residence and may bring proceedings before the courts where you live.
